Introduction

www.kitecareers.com is an online website owned by MPKI KITECAREER LLP, a Limited Liability Partnership company incorporated in India, for developing software that educates people for the better.

Registration and Acceptance

The terms and conditions, obligations, representations, warranties, and agreements contained herein (“Terms”) govern your participation as a user of www.kitecareers.com.

You will be deemed to have accepted these Terms if you view or use in any manner any content, information, course materials, products, and services (“Services”) provided or available on the Website, which is owned and maintained by MPKI KITECAREER LLP (“Us”, “We”, or “Our”).

By using our platforms and submitting UGC to our Web App or Mobile Apps, you confirm that you accept this User-Generated Content Policy, our Privacy Policy, and our Terms of Use, and agree to comply with them.

1. Your UGC

  1. All content submitted to KiteCareers mobile app and web app, including your name, biographical information, usernames, pseudonyms, text, graphics, images, photographs, forum comments, and all other material, shall be referred to as your “UGC”.
  2. You agree to submit UGC according to the Legal Standards and Review Guidelines.
  3. Publication of your UGC is at our sole discretion. We may edit, remove, or refuse publication.
  4. Any UGC submitted will be considered non-confidential and non-proprietary.

2. Rights, Permissions & Waivers

  1. You grant MPKI KITECAREER LLP and affiliates a non-exclusive, perpetual, irrevocable, transferable, royalty-free license to use, reproduce, and publish your UGC.
  2. You confirm that all UGC submitted is your own work or you have obtained the required permissions.
  3. If your UGC includes images or identifies individuals, proper consent must be obtained.
  4. You waive all moral rights and publicity/privacy rights related to your UGC.

3. Content Standards – Legal Standards

  • Must not infringe copyrights, trademarks, privacy, or other rights.
  • Must not contain defamatory material.
  • Must not impersonate another person or entity.
  • Must not breach legal or fiduciary duties.
  • Must not promote discrimination or hate.
  • Must not contain malicious code or harmful software.
  • Must comply with all applicable laws.

4. Content Standards – Review Guidelines

  • UGC must be accurate where it states facts.
  • UGC must genuinely reflect opinions where opinions are expressed.

5. Prohibited Content

  • Obscene, hateful, offensive, or inflammatory content.
  • Harassment, cyber-bullying, or threatening material.
  • Sexually explicit content.
  • Violence or illegal activity.
  • Spam, junk mail, or unauthorized advertising.
  • Misleading content pretending to be endorsed by KiteCareers.

6. Consequences of Breach

If you fail to comply with this UGC Policy, we may suspend your access to the Website or Apps and remove your UGC.

You may also be liable for any loss or damage caused to us due to your breach of these Terms.

Course Materials

As part of our Services, we grant access to content, course materials, practice tests, and other resources in audio/video, written, graphic, recorded, photographic, or machine-readable formats.

We reserve the right to amend or update the course materials and may require additional fees for updated content.

Grant of License

We grant you a personal, restricted, non-transferable, non-exclusive, and revocable license to use the Services and course materials for personal and non-commercial use only.

If no duration is specified in the purchased package, access will be valid for 6 months from the date of purchase.

Ownership of Course Materials & Intellectual Property Rights

We are the sole and exclusive owner of the Website, Services, and course materials, including all trademarks, logos, and intellectual property rights.

Referrals

You will receive a referral reward only if the referred user signs up and pays for one of the courses. No reward will be given if the referred user only signs up without purchasing.

Communication and SMS Terms

The Company may contact users through SMS, email, telephone calls, and WhatsApp in accordance with applicable laws.
